7TH HOUR STUDIO — TERMS OF SERVICE

These Terms of Service (“Terms”) govern your use of 7th Hour Studio’s website and services. By engaging us for a project or using this website, you agree to these Terms.

1. Our Services

7th Hour Studio provides website design and development, website revamps and optimization, landing pages, SEO foundations, and related digital services, as described on our Services and Website Revamps pages. The specific scope, deliverables, and timeline for any project will be confirmed in a written proposal or quotation before work begins.

 

2. Discovery Calls and Quotations

A discovery call does not constitute a binding agreement. Pricing ranges shown on this website are indicative only. A project begins only once both parties agree to a written proposal or quotation outlining scope, price, payment structure, and timeline for that specific project.

 

3. Payment Terms

Payment terms for each project, including deposit amount, milestone payments, and final payment, will be set out in the signed proposal or quotation for that project and form part of these Terms once agreed. Work will not begin, and deliverables will not be released, until the payment terms specified for that project have been met.

Late payment may result in pausing of work until payment is received.

 

4. Revisions

Each package includes a set number of revision rounds, as specified in the project proposal (see our Pricing Framework: Starter includes 1 round, Growth includes 2 rounds, Premium includes 3 rounds). Additional revision rounds beyond what’s included may be billed separately, as agreed in advance.

 

5. Cancellations and Refunds

If a client wishes to cancel a project after work has begun, refund eligibility will be assessed based on work already completed and time already committed, and discussed directly between the client and 7th Hour Studio. Any deposit paid to secure a project slot is generally non-refundable once discovery or strategy work has commenced, unless otherwise agreed in writing for that specific project.

 

6. Ownership and Intellectual Property

Once a project is delivered and paid for in full, the client owns the final website and its content for their own business use.

7th Hour Studio retains the right to:

  • Display the completed project in our portfolio, case studies, and marketing materials, unless the client requests otherwise in writing
  • Reuse general design concepts, templates, and non-client-specific code or techniques developed during the project for future work with other clients

 

Any third-party assets used in a project (e.g. stock images, licensed fonts, paid plugins) remain subject to their own original licensing terms, and responsibility for ongoing license fees, if any, will be specified in the project proposal.

 

7. Client Responsibilities

To keep a project on schedule, clients are responsible for providing requested content (text, images, logos, login access, etc.), feedback, and approvals within a reasonable time. Delays in client feedback may extend the agreed project timeline accordingly.

 

8. Website Care & Maintenance

Where a client subscribes to a Website Care & Maintenance plan, the specific scope of that plan (updates, backups, security monitoring, content changes) will be outlined separately at the time of subscription. Maintenance plans are billed monthly and may be cancelled by either party with reasonable notice, as specified at the time of subscription.

 

9. Limitation of Liability

7th Hour Studio will perform services with reasonable skill and care, but does not guarantee specific business outcomes (such as a specific number of leads, sales, or search engine rankings), since these depend on many factors outside our control. We are not liable for indirect or consequential losses arising from use of a website we’ve built, beyond the value of the services paid for.

 

10. Third-Party Tools and Hosting

Some projects may involve third-party tools, plugins, hosting providers, or platforms. These are subject to their own separate terms and pricing, which will be disclosed to the client where relevant.

 

11. Governing Law

These Terms are governed by the laws of Kenya. Any disputes will first be addressed through direct, good-faith discussion between the parties before any other action is pursued.

 

12. Changes to These Terms

We may update these Terms from time to time. Continued use of our website or services after changes are posted constitutes acceptance of the updated Terms.
